These Terms and Conditions apply to purchases made through this website for Miller AG Supplies, Pyramid Hill and TJ Stockfeeds, Kerang.

By placing an order through this website, you agree to these Terms and Conditions.

Sales and Purchases

We sell, and you purchase, goods listed on this website in accordance with these Terms.

All orders are subject to acceptance by us. We may refuse or cancel an order for reasons including:

• Items being out of stock
• Pricing errors
• Unable to obtain payment authorisation
• Incorrect stock numbers or stocktake errors
• Supplier issues or other matters outside our control

You must provide accurate information when placing an order, including billing details, delivery address and contact details.

Pricing and Payment

Unless otherwise stated, all prices shown on this website are in Australian Dollars (AUD) and include GST.

Payment is due at the time of order using the payment methods available on this website. If payment cannot be processed, we may cancel your order and notify you.

Stock and Availability

We do our best to keep website stock levels accurate, but we cannot guarantee that all items will always be available. Stock levels may be affected by incorrect stock counts, supplier issues, or other matters outside our control.

If an item is unavailable after you place an order, we will contact you. You may be offered a substitution, the option to wait until the item is back in stock, or a full refund.

We also do our best to keep product information accurate, however please note:

• Product photos and packaging shown on the website are for illustrative purposes only.
• Suppliers may change product packaging without notice.
• Products may vary slightly due to seasonal changes or product availability.
• Product descriptions are summaries and may be based on supplier information.
• Human error may occur. Where we become aware of an error, we will correct it as soon as possible.

We reserve the right to limit purchases to normal retail quantities.

Shipping and Delivery

We will deliver goods to the address you provide, where delivery is available.

For large deliveries where machinery or suitable equipment is required to unload items, we will coordinate a suitable delivery time with you.

If we attend a delivery and the goods cannot be unloaded because you are not available, cannot be contacted, or the delivery location is not suitable, a delivery fee may still apply and the goods may not be delivered at that time.

You should inspect goods on delivery and notify us as soon as possible of any damage, defect or shortage.

Returns, Refunds and Faulty Goods

We are committed to honouring your rights under the Australian Consumer Law.

We will assist you where goods purchased from us:

• Are faulty or do not work as intended
• Are the wrong product or do not match the product description
• Have defects that were not made known to you before purchase or delivery
• Are not fit for purpose

Change of mind returns may be accepted on a case-by-case basis. However, we cannot accept change of mind returns for all products.

This may include situations where:

• The product was custom made or specifically ordered in
• Quality control is lost once the product leaves our store
• Stockfeed may have been stored incorrectly after purchase
• Vaccines or temperature-sensitive products may have been exposed to heat or unsuitable storage conditions

Warranty and Disclaimer

Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law that cannot legally be excluded.

Other than any non-excludable rights under the Australian Consumer Law, our liability is limited to the extent permitted by law.

We make no other warranties or representations beyond those stated in these Terms.

Intellectual Property

All content on this website, including text, graphics, logos, images and other material, is owned by us or used under licence.

You may not reproduce, adapt or distribute any part of this website without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law, we exclude liability for indirect, special, incidental or consequential loss, including loss of profit, business or goodwill.

Our total liability for any claim connected with these Terms is limited to the amount you paid for the goods giving rise to the claim, except where the law does not allow this limitation.

Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.

Changes to These Terms

We may update these Terms at any time by posting an amended version on this website.

Your continued use of the website, or placing an order after the Terms are updated, means you accept the updated Terms.

General

If any part of these Terms is found to be invalid or unenforceable, that part will be removed and the remaining Terms will continue to apply.
